latinoamericana sobre los derechos de los pueblos indígenas a la propiedad de la tierras y
recursos, a la participación y la consulta previa.</b></p>
<p style="text-align:justify">El texto sistematiza y analiza una selección de sentencias de
cortes de nueve países de América Latina.</p>
<p style="text-align:justify"><b>Se trata de sentencias paradigmáticas</b> en el
avance del reconocimiento los derechos de los pueblos indígenas, muchas de ellas dictadas en
contextos políticos adversos.</p>
<p style="text-align:justify">La compilación está ordenada por temas y reproduce
extractos de decisiones judiciales de cortes y tribunales constitucionales y de cortes supremas de
nueve países de América Latina: <b>Argentina, Bolivia, Colombia, Chile, Ecuador,
Guatemala, Nicaragua, Panamá y Perú.</b></p>
<p style="text-align:left">Por cierto, como señala el Prólogo de James Anaya, junto
con los avances, la compilación permite observar que "<i>dentro de la jurisprudencia
latinoamericana aún existen vacíos y divergencias en la interpretación de las
normas internacionales", "en donde pueden percibirse diversos intereses en juego y visiones
encontradas entre gobiernos, pueblos indígenas, empresas privadas y otros actores". </i></p>

El libro presenta las diferentes maneras en que normas internacionales -como el Convenio 169 de
la OIT o la Declaración de las Naciones Unidas sobre los derechos de los pueblos
indígenas- han sido interpretadas y aplicadas en diferentes contextos jurídicos,
políticos y culturales.<br>
El Digesto cuenta con las reflexiones del Relator Especial de las Naciones Unidas para los
derechos humanos y las libertades fundamentales de los pueblos indígenas, James Anaya, quien
escribió el prólogo, y de Humberto Sierra Porto, Presidente de la Corte Interamericana
de Derechos Humanos, autor del epílogo.<br>
<b>La compilación fue elaborada por la Fundación Para el Debido Proceso,
FPDP.</b><br>
Felicitamos la preparación y publicación de esta compilación,
útil herramienta para el estudio y defensa jurídica, una de las dimensiones de
las contiendas por los derechos de los pueblos indígenas.<br>
